Terms of Service

These Terms of Service ("Terms") govern your use of Send FAX Mail (the "Service"), operated by Send FAX Mail ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Send FAX Mail is a fax-to-email service that lets you send and receive faxes online without a fax machine, with optional dedicated fax numbers and email delivery of fax content and status.

You must be at least 18 years old to use the Service. You agree to provide accurate account information, verify your email address where required, and keep your credentials secure. You are responsible for all activity that occurs under your account.

You agree not to use the Service to:

• Send faxes that are unlawful, fraudulent, or harmful.
• Send unsolicited advertisements or junk faxes in violation of the Telephone Consumer Protection Act (TCPA) or other anti-spam laws.
• Harass, threaten, or impersonate others.
• Distribute malware or attempt to disrupt or breach the Service.
• Reverse-engineer or resell the Service without authorization.

We may suspend or terminate accounts that violate this section, with or without notice.

Paid plans are billed monthly (or annually) through Stripe and renew automatically until canceled. There are no per-page overage charges; if you reach your plan's monthly page allowance, you can upgrade to a higher plan at any time. You authorize us to charge your payment method for all applicable fees.

Refunds

We want you to be happy with the Service. If you are not satisfied, email legal@sendfaxmail.com and we will make it right. We offer a refund of your most recent subscription charge within 30 days of that charge, no questions asked, and we promptly refund accidental renewals on request. We would always rather resolve a billing concern directly than have you file a dispute, so please reach out first — we respond quickly. (Certain third-party fax-transmission or phone-number costs already incurred may be non-refundable, but we err toward the customer.)

If a payment fails, we may retry the charge and may suspend paid features until payment succeeds.

Fax delivery is provided on a best-effort basis and depends on carrier networks and the recipient's fax line; we cannot guarantee that every fax will be delivered. You are responsible for the accuracy of recipient numbers and for the lawfulness of the content you send.

Dedicated fax numbers are provisioned based on your plan. If you downgrade or cancel, numbers beyond your new plan's limit are suspended and enter a 30-day grace period; upgrading within that window restores them, after which they may be permanently released.

You may cancel at any time through the billing portal; cancellation takes effect at the end of your current billing period. On cancellation, dedicated numbers and stored faxes are handled as described in these Terms and our Privacy Policy. We may suspend or terminate accounts that violate these Terms.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every fax will be delivered.

To the maximum extent permitted by law, Send FAX Mail will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

You agree to indemnify and hold harmless Send FAX Mail from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Nevada for any dispute not subject to other agreed resolution.

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
